OVERVIEW

Welcome to GAZO. The terms “we”, “us” and “our” refer to GAZO. GAZO operates this website and online store, including the information, content, features, products and services made available through it (the “Services”). Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with any policies referred to in them, explain the terms that apply when you access our website, use our Services or purchase products from GAZO.

Please read these Terms carefully before using our Services or placing an order.

If you create an account, you are responsible for keeping your account credentials secure and for activity carried out through your account. You must not transfer, sell or assign your account to another person without our permission.

SECTION 2 - OUR PRODUCTS

GAZO sells both new and carefully selected pre-owned clothing and fashion items.

We make reasonable efforts to describe and photograph our products accurately. However, colours and appearance may vary slightly depending on your device, display settings and lighting conditions.

For pre-owned products, signs of previous use, age or wear may be present. We aim to disclose noticeable marks, wear, damage or other relevant imperfections in the product description and/or photographs.

Please review the product description, photographs, condition information, sizing and measurements carefully before purchasing.

Nothing in this section affects your statutory rights. Products supplied by GAZO must comply with applicable UK consumer law, including requirements relating to description, quality and fitness for purpose where applicable.

Product availability may change without notice. We may discontinue products or limit quantities where reasonably necessary.

Unless expressly stated otherwise, GAZO is an independent reseller and is not affiliated with, sponsored by or endorsed by the brands whose products may be offered on our website. Brand names and trademarks remain the property of their respective owners.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase the products in your order.

Your order is accepted when we confirm acceptance of the order. Payment may be authorised or processed as part of the ordering process.

We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, pricing or product information contains a genuine error, payment cannot be authorised, or we reasonably suspect fraud or misuse.

If we cancel an order after payment has been taken, any amount due back to you will be refunded.

Nothing in these Terms restricts any statutory cancellation rights you may have when purchasing online.

SECTION 4 - PRICES AND PAYMENT

The price charged for a product will be the price displayed when you place your order, subject to correction of obvious pricing errors where permitted by law.

Prices displayed to UK consumers will include any taxes that are required by law to be included in the advertised price.

Delivery charges, where applicable, will be displayed before you complete your purchase.

You agree to provide accurate and complete payment and billing information and confirm that you are authorised to use the payment method provided.

We may offer discounts or promotions from time to time. Additional terms may apply to individual promotions.

SECTION 5 - SHIPPING AND DELIVERY

Available delivery methods, estimated delivery times and applicable delivery charges are displayed during checkout and/or in our Shipping Policy.

Delivery times are estimates unless we expressly agree otherwise.

We are not responsible for delays caused by circumstances genuinely outside our reasonable control. However, nothing in this section limits your rights under applicable UK consumer law.

Where GAZO arranges delivery, the risk of loss or damage to the goods remains with GAZO until the goods come into the physical possession of you, or a person identified by you to receive them, except where applicable law provides otherwise.

Please ensure that the delivery information supplied with your order is accurate and complete.

SECTION 6 - INTELLECTUAL PROPERTY

The content of our Services, including our original text, graphics, photographs, website design, logos and other materials, may be owned by or licensed to GAZO and is protected by applicable intellectual property laws.

These Terms allow you to use our Services for personal, non-commercial purposes.

You must not reproduce, distribute, modify, republish, commercially exploit or otherwise use protected material belonging to GAZO without our prior permission, except where permitted by law.

Nothing in these Terms grants you ownership of any intellectual property belonging to GAZO, Shopify or any third party.

Shopify’s name, trademarks and other intellectual property belong to Shopify or its licensors.

Third-party brand names, logos and trademarks displayed in connection with products remain the property of their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may provide access to tools or services supplied by third parties.

We do not necessarily control or operate these third-party tools. Your use of them may also be subject to the third party’s own terms and privacy policies.

To the extent permitted by law, we are not responsible for third-party tools or services that we do not control.

Nothing in this section excludes liability that cannot lawfully be excluded.

Our Services may contain links to websites or services operated by third parties.

GAZO does not control third-party websites and is not responsible for their content, availability or practices.

Nothing in this section excludes or limits liability where doing so would be unlawful.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

GAZO is powered by Shopify, which provides the ecommerce platform that enables us to provide the Services.

However, purchases made from our store are transactions directly between you and GAZO.

Shopify is not the seller of the products offered by GAZO.

Nothing in this section affects any rights you may have under applicable law.

If you voluntarily submit reviews, suggestions, feedback, photographs or other content to us (“Feedback”), you confirm that you have the right to provide that content.

You must not submit Feedback that is unlawful, defamatory, misleading, abusive, obscene, fraudulent, infringes another person’s intellectual property or privacy rights, or contains malicious software.

Where permitted by law, you grant GAZO a non-exclusive, worldwide, royalty-free licence to use Feedback you voluntarily provide for purposes connected with operating, improving and promoting our business and Services.

We will not knowingly present fake consumer reviews as genuine reviews.

SECTION 12 - ERRORS AND INACCURACIES

We aim to ensure that information displayed through our Services is accurate.

Occasionally, information may contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, availability, pricing, promotions, delivery charges or delivery estimates.

Where permitted by law, we may correct genuine errors and update information.

Nothing in this section allows us to remove or restrict statutory consumer rights.

We make reasonable efforts to ensure that our website and Services operate correctly and that information provided by us is accurate.

We cannot guarantee that the website will always be uninterrupted, completely error-free or continuously available.

Nothing in these Terms excludes, restricts or limits any statutory rights or warranties that cannot lawfully be excluded or restricted.

In particular, nothing in these Terms affects your rights under applicable UK consumer law in relation to goods that are faulty, not as described, not of satisfactory quality or otherwise fail to conform to the contract.

SECTION 17 - LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot legally be excluded or limited.

Nothing in these Terms excludes or restricts your statutory rights as a consumer.

Subject to the above, GAZO will not be responsible for losses that were not reasonably foreseeable when the contract was formed or for losses resulting from circumstances outside our reasonable control, to the extent permitted by law.

If you use products purchased from GAZO for business or commercial purposes, different legal rules may apply.

SECTION 18 - INDEMNITY

If you use the Services for unlawful purposes or materially breach these Terms, you may be responsible for losses reasonably incurred by GAZO as a direct result of that conduct, to the extent permitted by applicable law.

Nothing in this section affects your statutory rights or imposes liability that cannot lawfully be imposed on a consumer.

SECTION 19 - SEVERABILITY

If any provision of these Terms is found by a court or competent authority to be unlawful or unenforceable, that provision will be treated as modified or removed only to the extent necessary.

The remaining provisions will continue to apply.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

These Terms, together with the policies expressly incorporated into them, form the agreement governing your use of the Services and purchases from GAZO.

Nothing in these Terms excludes rights or obligations that cannot legally be excluded.

SECTION 21 - ASSIGNMENT

You may not transfer your rights or obligations under these Terms to another person without our prior consent where consent is reasonably required.

We may transfer our rights or obligations under these Terms where permitted by law, provided that doing so does not reduce your statutory rights.

SECTION 22 - GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you will also benefit from any mandatory protections available to you under the laws applicable in the part of the United Kingdom where you live.

Nothing in these Terms prevents a consumer from bringing proceedings in a court where they are legally entitled to do so.
